PAYMENT AND CANCELLATION

Completely equipped boats may be chartered only if the payment was discharged in full.

If the charter is cancelled for any reason, the charterer can transfer his/her rights and commitments to other person by preliminary arrangement with the charter company. If other person is not found on time, the cancellation expenses would be charged as follows:

- cancellation up to 1 month before charter 50% of charter fee

- cancellation within 1 month before charter 100% of charter fee

- 25% of boat price due within 7 days of booking confirmation

- 25% of boat price due 8 weeks before the check-in

- 50% of boat price due 4 weeks before the check-in

In case of closed borders due to COVID19 (Croatian border or the one from which the guest is coming), we offer full refund or free reschedule up to 8 weeks before the check-in.

TAKEOVER (CHECK-IN)

The charter company will provide fully equipped boats, with full fuel and water tanks and in faultless condition (the engine and the hull inspection are necessary part of every check-out procedure). The same condition of the boat is expected at its return.

At the takeover (check-in) the charterer has to check and carefully inspect the condition of the yacht and its equipment. Any later detected defaults of the yacht or its equipment which could not have been known to the charter company at the time of the transfer of the yacht, as well as any defects which may occur after the check-in, shall not give the charterer any right to a deduction on the charter price.

If the charter company is, for any reason, not able to provide the reserved boat on scheduled time, they can provide other boat, at least identical (or better) to the reserved one. If the reserved boat is not provided within 24 hours, the charterer can cancel the reservation and claim the reimbursement of the charter price.

If for any reason the further navigation during the charter period is not possible, or scheduled return of the boat has to be postponed, the charter company (base manager) has to be contacted immediately for further instructions. In case of exceeding the scheduled return of the boat for weather conditions the charterer covers all the expenses that could derive to the charter company. Therefore, it is recommended to plan the safe returning route, and in case of bad weather to return to the marina earlier than scheduled check-out.

DEPOSIT

The deposit has to be paid according to the valid price list at the takeover of the yacht (cash or credit card). It is refundable in full, in case the boat is returned undamaged and on scheduled time. The deposit has to be paid in case the boat is chartered with skipper too. The charterer covers all the expenses derived from negligence, misuse and loss of part(s). When using credit cards for security deposit, the client should be aware that the stated amount of money on that account will be reserved and blocked by the bank for some time.

INSURANCE

The boat has the Third person liability and full comprehensive insurance on registered value of the boat for all the risks normally covered by the insurance policy. The insurance is valid if the chartered vessel sustains loss or damage due to marine or traffic accident, sinking, capsizing, grounding, fire, explosion, burglary, theft of the whole vessel, breaking of masts and/or spars, breaking of standing and running rigging, collision with or impact of any fixed or floating object, malicious acts by third parties. The insurance is excluded in cases of: deliberate acts or gross negligence, influence of alcohol or drugs, loss or damage due to force majeure. In case of more extensive damage, (as in case of colliding with other boats), reporting to the nearest Port authority is an obligation. The protocol (incident development, estimation of the damage) has to be made for the insurance company and the charter company has to be informed immediately. If the charterer does not fulfil all the commitments, he/she could be charged for all the damage. Damage on sails is not covered by the insurance and the charterer covers all the possible expenses. caused by loss of oil. Therefore, the charterer should check the level of engine oil on regular bases. For any repairs, the instructions of the base manager are needed. Personal items are not covered by the insurance.

CHARTERER COMMITMENTS

The charterer is obliged to sail within Croatian territorial waters; all the exceptions need a special approval or licence. It is not permitted to sub-lease the boat or transfer it to the third person, to embark more persons than on the crew-list, to sail at night during unsafe weather conditions or to violate public regulations, rules or laws. The charterer is responsible for all the consequences.

The charterer or skipper declares by signing of the charter contract to be in possession of a valid licence to operate the craft on open sea. The charter company has the right to refuse a charterer if he/she does not have the proper documents for, and knowledge of handling the vessel. In this case the charterer has to hire a skipper on his/her own expense in order to be able to charter the yacht. In case the charterer brings a dog aboard, he/she should inform the charter company in advance and shall pay the extra cleaning costs in the amount of € 100 at the takeover.

In case of failure on the boat or its equipment, the charterer has to inform the charter company (base manager) immediately. The charter company is obliged to repair the failure as soon as possible. In case the failure is repaired within 24 hours, the charterer has no right to reimbursement. The charterer is obliged to inform authorities and the charter company in case of loss of the boat or its equipment, malfunction in operating the boat, dispossession, confiscation or prohibition of navigation by the state authorities or other persons. The charterer bears all the responsibility towards the charter company for all the consequences.

RETURNING OF THE YACHT

After termination of the charter trip the charterer must return the vessel with full tanks of fuel and water, and the full equipment as on the takeover. The charterer is responsible to return the yacht on time. The trip timetable must be planned to such an extent that the yacht can reach the base harbor on time, independent of weather conditions. In case of an expected delay in the return, the charter company must be informed immediately. The charterer will be charged for each full hour of delay in the return with 2% of the relevant weekly charter rate and moreover the charterer is fully liable for the sequential damages caused by his/her delay to the following charter of the yacht.

COMPLAINTS

Any complaints shall be made in writing and signed by both parties immediately upon return and transfer of the yacht.

ARBITRATION

In case that a dispute cannot be mutually settled, the arbitration is under the jurisdiction of the company’s Court in Split.

The crew list is a legal requirement that needs to be sent to the Croatian Ministry for Maritime Affairs. We will not provide or disclose the data to any other third parties.
